Welcome to 888 Archive. Throughout these Terms of Service, the terms “888 Archive,” “we,” “us,” and “our” refer to 888 Archive.

888 Archive offers jewelry, accessories, and related products through the Services.

We make reasonable efforts to accurately display and describe our products, including their appearance, dimensions, materials, finishes, colors, photographs, and other characteristics. However, product photographs and digital representations may not perfectly reflect the appearance of an item in person.

Colors, brightness, texture, finish, reflections, stones, metals, plating, engraving, and other visual details may appear differently depending on your device, display settings, lighting conditions, camera settings, and surrounding environment.

Because jewelry may contain polished, plated, coated, engraved, textured, handmade, or individually assembled components, minor variations between individual products may occur. Such variations do not necessarily constitute a defect.

Product measurements are approximate unless specifically stated otherwise. Customers are responsible for reviewing measurements, bracelet lengths, chain lengths, dimensions, sizing guidance, and other specifications before purchasing.

We do not guarantee that any product will look exactly as it appears in photographs, digital mockups, promotional imagery, social media content, or other visual representations.

Unless expressly stated otherwise, jewelry finishes and plating may naturally change over time due to wear, friction, moisture, chemicals, sweat, cosmetics, oils, perfumes, environmental exposure, storage conditions, or the manner in which the product is used.

We may update product descriptions, materials, designs, specifications, packaging, prices, available sizes, inventory, or other product details at any time without prior notice.

We also reserve the right to limit quantities, discontinue products, restrict sales to particular customers or locations, or modify our product offering at our discretion, subject to applicable law.

SECTION 3 - JEWELRY CARE, WEAR, AND CUSTOMER RESPONSIBILITY

Jewelry is subject to ordinary wear and requires appropriate care.

Unless a product page expressly states otherwise, you should avoid exposing jewelry to excessive moisture, swimming pools, saltwater, cleaning products, lotions, perfumes, harsh chemicals, abrasive surfaces, or prolonged contact with sweat.

Customers are responsible for using, wearing, storing, cleaning, and maintaining jewelry appropriately.

Scratching, fading, tarnishing, oxidation, discoloration, plating wear, bending, accidental breakage, loss, damage from impact, damage resulting from improper storage, or damage caused by exposure to chemicals or moisture may constitute normal wear or customer-caused damage and may not qualify as a manufacturing defect.

Jewelry may contain materials that certain individuals are sensitive or allergic to. Unless we expressly represent a product as hypoallergenic or suitable for a particular sensitivity, we do not guarantee that a product will be compatible with every customer’s skin or allergies.

Customers with known metal sensitivities, allergies, or skin conditions should carefully review any disclosed material information before purchasing or wearing a product.

SECTION 4 - ORDERS

Submitting an order through our store constitutes an offer by you to purchase the selected products.

An order is not considered finally accepted by 888 Archive merely because you submit payment information or receive an automated order confirmation.

We reserve the right, subject to applicable law, to accept, reject, cancel, limit, or modify an order for reasons including suspected fraud, pricing errors, inventory issues, payment problems, shipping restrictions, product availability, inaccurate customer information, violation of these Terms, or other legitimate business reasons.

If we cancel an order after collecting payment, we will issue any refund required by applicable law or our applicable policies.

Once an order enters processing or fulfillment, we may be unable to change or cancel it.

Purchases are eligible for refunds, returns, exchanges, or store credit only as described in our Refund Policy and as otherwise required by law.

Unless we expressly authorize otherwise, products purchased from 888 Archive are intended for personal use and not unauthorized commercial resale, redistribution, or export.

We reserve the right to limit or cancel orders that appear, in our reasonable judgment, to have been placed by resellers, distributors, bots, unauthorized purchasing services, or other commercial purchasers.

The amount charged for an accepted order will generally be the price displayed at the time the order was submitted, subject to correction of obvious pricing, technical, or typographical errors where permitted by law.

Unless expressly stated otherwise, displayed product prices do not include shipping charges, handling fees, taxes, customs duties, brokerage fees, import charges, or other governmental assessments.

You are responsible for all charges associated with your purchase that are properly disclosed or imposed under applicable law.

Promotional offers, coupon codes, discount codes, sale prices, free-shipping offers, bundles, and other promotions may be subject to additional conditions. We may modify or discontinue promotional offers at any time, subject to applicable law.

Promotional codes generally have no cash value and may not be combined unless we expressly permit it.

You agree to provide complete, accurate, and current billing, shipping, payment, and account information.

You further represent that you are authorized to use any payment method submitted through the Services.

You authorize us and our payment service providers to charge the applicable purchase amount, including taxes, shipping, and other disclosed charges, to the payment method you provide.

If your payment method is rejected, reversed, disputed, suspected to be fraudulent, or otherwise cannot be processed, we may delay, suspend, or cancel your order.

SECTION 6 - SHIPPING AND DELIVERY

Shipping and delivery dates provided by 888 Archive are estimates unless expressly guaranteed in writing.

Processing times and carrier transit times are separate. An estimated shipping or delivery window does not guarantee that an order will arrive on a specific date.

Delivery may be affected by carrier delays, weather, holidays, customs processing, inaccurate addresses, security checks, high order volume, transportation disruptions, governmental actions, or other circumstances beyond our reasonable control.

888 Archive is not responsible for carrier delays or other delivery delays outside our reasonable control.

Customers are responsible for entering a complete and accurate shipping address.

If an order is returned, delayed, lost, or misdelivered because you supplied an incorrect or incomplete address, additional shipping fees or other conditions may apply before the order can be resent.

Once an order has been transferred to the applicable carrier, risk of loss and responsibility for delivery will transfer as provided by applicable law.

Tracking information, when available, is provided as a convenience and may not always update in real time.

For international shipments, customers may be responsible for customs duties, import taxes, brokerage charges, tariffs, or other fees imposed by the destination country. Unless expressly stated otherwise, such charges are not included in the purchase price or shipping fee paid to 888 Archive.

SECTION 7 - RETURNS, EXCHANGES, AND REFUNDS

Returns, exchanges, order cancellations, refunds, and store credits are governed by our Refund Policy, which is incorporated into these Terms by reference.

Except where permitted by law or expressly authorized by us in writing, you may not reproduce, copy, modify, distribute, republish, download, display, transmit, sell, license, create derivative works from, scrape, exploit, or commercially use any portion of our Services or intellectual property.

You may not use 888 Archive branding, photographs, graphics, product designs, product listings, advertisements, or other materials to falsely represent yourself as an authorized retailer, distributor, partner, representative, or affiliate of 888 Archive.

The name “888 Archive,” its associated marks, logos, graphics, product names, designs, and slogans may constitute trademarks or other proprietary assets of 888 Archive.

No license or ownership interest in any intellectual property is transferred to you by your use of the Services.

All rights not expressly granted under these Terms are reserved.

Shopify and other third-party names, trademarks, logos, and services remain the property of their respective owners.

SECTION 9 - OPTIONAL AND THIRD-PARTY TOOLS

Our Services may provide access to functionality, applications, software, payment services, widgets, tools, or integrations provided by third parties.

888 Archive may not operate, supervise, control, or monitor those third-party services.

To the fullest extent permitted by law, third-party tools are made available on an “as is” and “as available” basis without separate warranties or endorsements from 888 Archive.

888 Archive uses Shopify technology to operate portions of our online storefront and provide the Services.

Purchases of 888 Archive products are transactions between you and 888 Archive, not between you and Shopify.

Shopify provides technology and infrastructure that support our store but is not the seller of 888 Archive merchandise and is not responsible for fulfilling your order.

To the fullest extent permitted by law, you acknowledge that Shopify and its affiliates are not responsible for injuries, losses, damages, claims, or disputes arising directly from merchandise sold to you by 888 Archive.

Nothing in this section limits any legal rights you may independently have against Shopify in connection with services Shopify itself directly provides to you.

We may moderate, reject, edit, disable, or remove User Content where permitted by law.

You may not submit material that is knowingly false, fraudulent, unlawful, threatening, defamatory, obscene, infringing, malicious, or designed to introduce viruses or harmful code.

You may not impersonate another person or misrepresent the origin of User Content.

You are solely responsible for the accuracy and legality of content you submit.

Our website may occasionally contain typographical errors, technical errors, outdated information, inaccuracies, or omissions.

Inventory displayed through our store may not always reflect inventory in real time.

A product appearing as available does not guarantee that the product will remain available until your order is accepted and fulfilled.

WE DO NOT WARRANT THAT THE SERVICES WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, ACCURATE, OR ERROR-FREE.

WE DO NOT GUARANTEE THAT ALL DEFECTS OR ERRORS IN THE SERVICES WILL BE CORRECTED.

SOME STATES OR JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS. WHERE SUCH RESTRICTIONS APPLY, THESE DISCLAIMERS WILL APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

SECTION 18 - LIMITATION OF LIABILITY

THIS INCLUDES, WITHOUT LIMITATION, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF SAVINGS, LOSS OF BUSINESS OPPORTUNITY, LOSS OF DATA, REPLACEMENT COSTS, OR SIMILAR DAMAGES, REGARDLESS OF WHETHER THE CLAIM IS BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANOTHER LEGAL THEORY.

TO THE FULLEST EXTENT PERMITTED BY LAW, THIS LIMITATION APPLIES TO CLAIMS ARISING FROM OR RELATING TO YOUR ACCESS TO THE SERVICES, INABILITY TO ACCESS THE SERVICES, PURCHASE OR USE OF PRODUCTS, RELIANCE ON INFORMATION, SHIPPING OR DELIVERY ISSUES, THIRD-PARTY SERVICES, OR ERRORS OR OMISSIONS IN CONTENT.

THE FOREGOING LIMITATIONS APPLY EVEN IF 888 ARCHIVE HAS BEEN ADVISED THAT SUCH DAMAGES MAY BE POSSIBLE.

WHERE APPLICABLE LAW DOES NOT PERMIT A PARTICULAR EXCLUSION OR LIMITATION OF LIABILITY, THAT EXCLUSION OR LIMITATION WILL APPLY ONLY TO THE MAXIMUM EXTENT LEGALLY PERMITTED.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

SECTION 19 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless 888 Archive and its affiliates, owners, directors, officers, employees, representatives, agents, contractors, licensors, and service providers from claims, liabilities, losses, damages, judgments, awards, costs, and reasonable attorneys’ fees arising from or related to:
